Terms and Conditions for Digital Download Products
These terms and conditions ("Terms") apply to the digital download ("Download") and the Victorian Piping Stencil provided by Rosie’s Dessert Spot ("Company") for personal use only. By downloading the digital content, you agree to these Terms in full.
1. Grant of License: 1.1. The Company grants you a personal, non-transferable, non-exclusive license to use the Download solely for personal, non-commercial purposes. 1.2. You may not sublicense, sell, rent, lease, distribute, transmit, or otherwise transfer the Download or any rights thereto to any third party.
2. Ownership: 2.1. All intellectual property rights in and to the Download and Victorian Piping Stencil, including but not limited to copyrights, trademarks, and trade secrets, are owned by the Company or its licensors. 2.2. These Terms do not grant you any rights to use the Company's name, logo, or trademarks without prior written consent.
3. Restrictions: 3.1. You may not modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Download or the Victorian Piping Stencil. 3.2. Any unauthorised use or violation of these Terms terminates the license granted herein.
4. Disclaimer of Warranty: 4.1. The Victorian Piping Stencil and Download is provided "as is" without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. 4.2. The Company does not warrant that the Download will meet your requirements or that the operation of the Download will be uninterrupted or error-free.
5. Limitation of Liability: 5.1. In no event shall the Company be liable for any direct, indirect, incidental, special, exemplary, or consequential damages (including, but not limited to, procurement of substitute goods or services; loss of use, data, or profits; or business interruption) however caused and on any theory of liability, whether in contract, strict liability, or tort (including negligence or otherwise) arising in any way out of the use of the Download or the Victorian Piping Stencil.
6. Governing Law: 6.1. These Terms shall be governed by and construed in accordance with the laws of Victoria, Australia, without regard to its conflict of law principles. 6.2. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Melbourne, Victoria, Australia, and you consent to the jurisdiction of such courts.
7. Release of Liability: 7.1. You acknowledge and agree that the Company shall not be liable for any injuries, damages, or losses, whether direct, indirect, incidental, special, consequential, or exemplary, arising out of or related to the use of the Download or the Victorian Piping Stencil. 7.2. By downloading the digital content or purchasing the Victorian Piping Stencil, you expressly waive any and all claims against the Company arising from or related to such injuries, damages, or losses.
8. Miscellaneous: 8.1. These Terms constitute the entire agreement between you and the Company regarding the Download and supersede any prior agreements or understandings. 8.2. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
By downloading the digital content and purchasing the Victorian Piping Stencil, you acknowledge that you have read, understood, and agree to be bound by these Terms.
